Cancellation Policy

BOOKING The Client agrees to pay the booking rates and charges stipulated above from the contract commencement date, herein stated, up to the contract conclusion date. TAMPERING No unauthorized persons shall tamper with, modify, access, or move the projection service rack without written consent / permission of the site, property and equipment owner, Christopher Carter, at any time. If the equipment rack requires any maintenance due to tampering, then a service fee of up to $500 will be applied to the invoice, and payment must be made within 3 business days of service date by Client. TERMINATION OF DEFAULT Upon the occurrence of any event of default by Client, the Vendor may, at its option, terminate the Contract by notice to the Client. If either party shall at any time commit any breach of any covenant, warranty or agreement contained herein, and shall fail to remedy the breach within ten (10) days after receiving the other parties written notice thereof, delivered via certified mail return receipt requested, the other party may at its option, and in addition to any other remedies that it may be entitled to terminate this Agreement by providing the offending party with written notice. NO ASSIGNMENT Neither this Agreement nor any of the rights and powers created herein may be assigned, whole or in part, by either party without the prior written consent of the other party. WAIVER Failure of either party at any time to require performance by the other party of any provision of this Agreement shall not affect in any way the full right to require such performance at any time in the future. The waiver of a breach or alleged breach of any provision of this Agreement shall not be construed or held to be a waiver of the provision itself or any other breach or alleged breach thereof. TIME OF THE ESSENCE ‘ Time is of the essence of this Contract and each and all of its Provisions. BINDING UPON HEIRS, EXECUTORS, SUCCESSORS AND ASSIGNS This Contract shall ensure to the benefit of and be binding upon the successors and assigns of the respective parties and heirs, executors and administrators. HEADINGS The insertion of headings in this Contract is for convenience of reference only and shall not affect the interpretation thereof. GOVERNING LAW This Contract shall be interpreted and enforced in accordance with the laws of the State of Florida . Venue for the resolution of any dispute shall be in Dade County, Florida at the Client sole discretion. The County or Circuit Court for the State of Florida the county selected by Client shall have exclusive jurisdiction for resolution of the dispute regardless of the amount in controversy or the diversity of the parties. FACSIMILE OR ELECTRONIC SIGNATURES It is hereby agreed by both parties that facsimile or electronic signatures are acceptable and shall be deemed fully binding, including in any legal Proceedings. In lieu of a signature, issuance of an invoice will act as acceptance to all the terms and conditions set forth in this agreement. FORCE MAJUER No discount will be allowed due to weather, act of god, attendance, and Covid 19 related situations. CREDIT CARD 3% Credit Card handling fee will be assessed for Credit Card Payments. 90 DAYS Invoices with outstanding balances past 90 days overdue will be sent to Collections. PAYMENT SCHEDULE Client agrees to pay 75% upfront and 25% upon completion of the event date.
